Welcome to ficago.ng, a proprietary website and mobile application operated by FicaGo Limited (“FicaGo”, “we”, “us”, or “our”).

By accessing or using the FicaGo platform (the “Platform”), you (“User”, “you”, or “your”) agree to be bound by these Terms and Conditions (“Terms”). These Terms govern your access to and use of our Platform and Services.

If you do not agree with these Terms, please do not access or use the Platform.

2.1. FicaGo operates a digital marketplace that enables users to discover, request, and book services offered by independent service providers, including artisans, technicians, and other skilled vendors (“Service Providers”).

2.2. FicaGo does not provide the services listed on the Platform. All services are provided solely by independent Service Providers. Any agreement for services is strictly between the User and the Service Provider.

2.3. FicaGo does not employ, supervise, direct, or control Service Providers and does not act as an agent, partner, joint venture, or representative of any Service Provider.

2.4. FicaGo makes no representations or warranties regarding the quality, safety, legality, suitability, pricing, or availability of any services offered by Service Providers.

3.1. You must be at least 18 years old and capable of forming legally binding contracts under Nigerian law to use the Platform.

3.2. By using the Platform, you represent and warrant that you meet these eligibility requirements.

4.1. To access certain features, you must create an account and provide accurate, complete, and up-to-date information.

4.2. You are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account.

4.3. FicaGo is not liable for any loss or damage arising from unauthorized access to your account. You must notify us immediately if you suspect any unauthorized use.

4.4. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

5.1. Requests made through the Platform constitute a request for services, not a guarantee that services will be provided.

5.2. Service Providers may accept or decline requests at their discretion.

5.3. FicaGo is not responsible for service outcomes, delays, cancellations, or dissatisfaction arising from services rendered by Service Providers.

6.1. Payments for services requested through the Platform are processed by third-party payment service providers.

6.2. FicaGo does not store or process full debit or credit card details.

6.3. FicaGo may facilitate payment collection or release between Users and Service Providers but is not responsible for the performance or completion of any service.

6.4. Refunds, where applicable, are subject to the Service Provider’s terms and any applicable Platform policies.

You agree to:

• use the Platform only for lawful purposes;
• provide accurate information at all times;
• treat Service Providers and other users respectfully;
• not misuse, exploit, or interfere with the Platform or its functionality.

You must not:

• use the Platform for fraudulent or unlawful purposes;
• impersonate another person or entity;
• reverse engineer, copy, or tamper with the Platform;
• attempt to bypass security features or access restricted areas.

9.1. All content, trademarks, logos, software, and materials on the Platform are owned by or licensed to FicaGo and are protected by intellectual property laws.

9.2. You may not copy, reproduce, modify, distribute, or exploit any part of the Platform without prior written consent from FicaGo.

10.1. By using the Platform, you consent to receiving electronic communications from FicaGo, including emails, notifications, and in-app messages.

10.2. Such communications satisfy any legal requirement for written communication.

11.1. The Platform and Services are provided on an “as is” and “as available” basis.

11.2. FicaGo disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

11.3. FicaGo does not guarantee uninterrupted, error-free, or secure access to the Platform.

12.1. To the maximum extent permitted by law, FicaGo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or Services.

12.2. FicaGo is not liable for the acts, omissions, conduct, or services of Service Providers or other users.

You agree to indemnify and hold harmless FicaGo, its directors, officers, employees, and partners from any claims, losses, damages, liabilities, or expenses arising from:

• your use of the Platform;
• your violation of these Terms;
• your interaction with any Service Provider.

14.1. FicaGo may suspend or terminate your access to the Platform at any time if you breach these Terms or applicable laws.

14.2. You may terminate your account at any time by discontinuing use of the Platform.

15.1. Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms.

15.2. By using the Platform, you consent to such processing.

We may update these Terms from time to time. Any changes will be posted on the Platform and will take effect upon publication. Continued use of the Platform constitutes acceptance of the revised Terms.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes shall be subject to the exclusive jurisdiction of Nigerian courts.
